E Efforts to Strengthen the Implementation of Consumer Protection Towards the Development of IKN in East Kalimantan: Upaya Penguatan Penyelenggaraan Perlindungan Konsumen Menyongsong Pembangunan IKN Di Kalimantan Timur

Abstract

Background: IKN development is like two sides of a coin in implementing consumer protection in East Kalimantan. In the midst of incomplete arrangements for implementing consumer protection due to the transfer of authority from districts/cities to provinces. As an implementation of decentralization and delegation, legislation is still regulated through a Gubernatorial Regulation which substantively only regulates BPSK technical matters. So the implementation of consumer protection is not yet optimal. Objective: of this research is to explore strengthening efforts to overcome problems in implementing consumer protection in East Kalimantan. Method: used is normative juridical, with a statutory approach, theory of authority, the principle of legal certainty, to explore philosophical, juridical and sociological values as an effort to strengthen consumer protection regulations and using prescriptive analytics.

Results: of the analysis and discussion show that there is a delegation of authority for implementing consumer protection in regional autonomy as a concurrent matter. The implementation of consumer protection in East Kalimantan as an implementation of decentralization and delegation of authority has not been regulated in the form of Regional Regulations.

Conclusion: As a form of ensuring consumer protection in East Kalimantan, it is necessary to strengthen regional regulations related to consumer protection.
